Florida's DUI manslaughter law and the "causation" rule is what may keep him out of jail. Since the victim was jaywalking and breaking the law when he was hit and killed, it could be argued that he contributed to his death.

Another comparable is that if a driver is drunk and stopped at an intersection and another car hits him and the driver of that car dies... should the drunk driver be held responsible for that death? In Florida, they say no.
